Eight decisions, chosen not because they were the largest but because the principle affirmed went beyond the single case, or because the result arrived where it looked unlikely.
Each is summarised here in English. The full text of every decision, with the Italian commentary, is in Law in Action.
Unnecessary surgery: the Santa Rita case
Court of Cassation, criminal division, 2017. Nine years of proceedings over operations performed for the money they generated. The firm acted for a civil party.
Good faith binds the tax authority too
Lodi tax court, 2006. The duty to act in good faith applies to the Revenue as much as to the taxpayer — affirmed before it became the usual language of Italian tax practice.
A gate, a changed lock, and possession restored
Monza, 2026. To be restored to possession you must prove use, not title — and the point survived a full appeal to the panel.
Building defects: from survey to judgment
Lodi, 2015. A preventive technical survey turned into a judgment on the merits, with individual flat owners joining a claim they would otherwise have lost.
Withdrawal from an online purchase
Milan justice of the peace, 2013. A seller's return-authorisation procedure cannot eat into the statutory period for withdrawing.
Who must prove the taxpayer wrong
Regional tax court, 2012. The Revenue's statistical estimates do not shift the burden of proof onto the taxpayer. The Agency's appeal was dismissed.
Five years without heating
Milan justice of the peace, 2021. Damages for the disruption to daily life caused by a utility that cut off the gas and would not reconnect it.
When the supplier fails, the loan follows
Monza, 2015. A consumer who financed a supply through a credit agreement does not owe the finance company once the supply has failed.
